1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "you") and Synapse Cube Private Limited, the owner and operator of Herb Soul ("we", "us", or "our"), accessible at herbsoul.in.

By accessing, browsing, or placing an order on our Platform, you unconditionally accept and agree to be bound by these Terms along with our Privacy Policy, Shipping & Delivery Policy, and Returns & Refunds Policy. If you do not agree, please do not use the Platform.

2. Eligibility

• You must be at least 18 years of age to place an order on the Platform
• You must be legally capable of entering into binding contracts under the Indian Contract Act, 1872

Herb Soul products are Ayurvedic formulations and health supplements. The following important disclaimers apply:

• Health-related claims about specific ingredients or formulations are based on traditional Ayurvedic knowledge and have not been evaluated by FSSAI as disease treatment claims

• Individual results may vary. Herb Soul makes no guarantee of specific outcomes from product use

4. Pricing & Availability

• All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
• Herb Soul reserves the right to modify prices at any time without prior notice
• In the event of a pricing error, we reserve the right to cancel the affected order and issue a full refund
• Product availability is subject to stock levels. We do not guarantee availability of any specific product at all times

5. Orders & Payment

By placing an order on the Platform, you represent that:

• The information provided (name, address, payment details) is accurate and complete
• You are authorised to use the payment method provided
• You are purchasing the product for personal, non-commercial use

Herb Soul reserves the right to refuse or cancel any order at its sole discretion, including for reasons of suspected fraud, pricing errors, or stock unavailability. If an order is cancelled after payment, a full refund will be processed to the original payment method.

6. Prohibited Conduct

Users shall not use the Platform for any of the following purposes:

• Engaging in fraudulent, misleading, or deceptive conduct
• Placing bulk or commercial resale orders without prior written consent from Herb Soul
• Using another person's payment credentials or personal information without authorisation
• Transmitting malicious code, viruses, or engaging in any activity that disrupts the Platform's functionality
• Misrepresenting the condition of returned products or making false damage claims
• Creating multiple accounts to exploit promotional offers, referral codes, or discount coupons
• Posting or transmitting any content that is unlawful, defamatory, obscene, or violates any third-party rights

7. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, product images, videos, and software — is the property of Synapse Cube Private Limited or its licensors and is protected under applicable intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999.

You may not reproduce, distribute, modify, create derivative works from, or use any content from the Platform for commercial purposes without prior written consent from Synapse Cube Private Limited.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Herb Soul and Synapse Cube Private Limited shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or our products
• Any loss of data, revenue, or business arising from system downtime, technical errors, or third-party service failures
• Any adverse health effects arising from product use contrary to the stated directions for use or in combination with prescription medications
• Delays in delivery caused by courier partners, natural events, or government restrictions

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 (thirty) days, the dispute may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi.

10. Amendments

Herb Soul reserves the right to amend these Terms at any time without prior notice. Amended Terms will be posted on the Platform with a revised 'Last Updated' date. Continued use of the Platform after amendments constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
